Terms of Service

1. Acceptance of Terms

By creating an account or using the Enki App service, you agree to be bound by these Terms of Service. If you do not agree, you may not use the service. These terms apply to all users, including individuals, family account holders, and organizational accounts.

2. Description of Service

Enki App is an automated personal safety platform that provides check-in scheduling, escalation notifications, and encrypted vault storage. The service is designed to notify designated contacts when a user fails to confirm their safety within a defined time window. Enki App is not an emergency dispatch service and does not contact emergency services on your behalf.

3. User Responsibilities

• You are responsible for maintaining the confidentiality of your account credentials.
• You must ensure that all trusted contacts have consented to being added to your account.
• You may not use the service to harass, surveil, or monitor individuals without their explicit consent.
• You are responsible for the accuracy of information stored in your vault.
• You must be 18 years of age or older to create an account.

4. Limitation of Liability

Enki App is a supplementary safety tool. EnkiLabs Technologies is not liable for outcomes resulting from failure to check in, network outages, device failures, or circumstances beyond our technical control. In jurisdictions where limitations on liability are restricted, liability is limited to the maximum extent permitted by law.

5. Subscription & Billing

Paid plans are billed monthly or annually as selected. Cancellation takes effect at the end of the current billing period. Refunds are issued at our discretion for unused annual plan periods. Free tier features remain available after downgrading from a paid plan.

6. Termination

We reserve the right to suspend or terminate accounts that violate these terms, engage in abusive behavior, or use the platform for unauthorized surveillance. You may delete your account at any time from your account settings. Upon deletion, all data is permanently removed within 30 days.

7. Governing Law

These terms are governed by the laws of the Province of Quebec, Canada, and the federal laws of Canada applicable therein, without regard to conflict of law provisions.
